Teen Husband Sentenced for Sex With Wife, 13

CONYERS -- A judge has sentenced a 19-year-old man who impregnated and then married a girl who was 13 at the time. Marcus Leonard Mundy, 19, was charged with misdemeanor statutory rape and sentenced to 10 years probation, and he must complete high school, make child support payments, pay $250 in court costs and attend a prison awareness program.
The relationship between Mundy and his future wife started in fall 2002, and when she became pregnant, the two got married.
Under Georgia law, a 13-year-old can't legally consent to sexual activity but can get married without her parents' consent.
The sentence also calls for Mundy to avoid contact with the girl without her family's approval and pay $1,000 in fines that will go into an account for the child. It was agreed on by attorneys.
"I have thought long and hard about this case, and it troubles me greatly," said Judge David Irwin. "Were it not for the wishes of the victim's family, Mr. Mundy would be going to jail."
